Conditions for applying for an Enterprise Registration Certificate for Study Abroad Consulting
When applying for an Enterprise Registration Certificate for study abroad consulting, you must meet the following conditions:
- The entity applying for the business license for study abroad consulting services must be a legal entity or organization established by the law, including enterprises with functions of providing study abroad consulting services.
- Regarding the team of direct study consulting staff:
- Must have a university degree or higher.
- Must have the ability to use at least one foreign language from level 4 or higher according to the Foreign Language Proficiency Framework, level 6 for Vietnam, or equivalent.
- Must have a certificate of training in study abroad consulting according to the regulations of the Ministry of Education and Training.

The implementation process is as follows:
Step 1: Before applying for the Enterprise Registration Certificate for the operation of study abroad consulting, you must complete the procedures to establish a business entity with the industry code for study abroad consulting (specifically, industry code 8560: Education Support Services).
In case you have not registered the establishment of a business entity or have established a business entity but do not yet have the industry code for study abroad consulting, SB Law will provide suitable services according to your needs.
Step 2: Prepare and draft the dossier for applying for the Enterprise Registration Certificate for study abroad consulting services in accordance with Decree 46/2017/ND-CP, amended and supplemented by Decree 135/2018/ND-CP, including:
- Letter requesting the issuance of the Enterprise Registration Certificate for study abroad consulting services;
- Authenticated copy of the Enterprise Registration Certificate, establishment decision, or Investment Registration Certificate;
- Lease contract or certified copy of land use rights certificate;
- List of direct study consulting staff;
- Certificates of training in study abroad consulting for the staff;
- University diplomas of the staff;
- Language proficiency certificates of the staff related to the countries for study abroad consulting;
- Authenticated copies of legal documents of the staff;
- Power of attorney (in case of authorization for another person to carry out the procedure for obtaining this Certificate).
Note: Although the dossier does not specify the requirement for documentation proving collaboration with educational institutions for which you intend to provide study abroad consulting, in practice, you should include supporting documents for this, such as Enrollment Cooperation Contracts, etc.
Step 3: After completing Step 2 and signing and sealing as required, submit the dossier for the Enterprise Registration Certificate for study abroad consulting services to the Department of Education and Training.
Submit online through the national public service portal. Additionally, the account used for dossier submission must be the account of the owner, legal representative, or head of the Company's branch, or the Company's account.
Step 4: The Department of Education and Training will review the dossier and verify the authenticity of the documents in the dossier at the location of study abroad consulting activities. If the conditions as prescribed are not met, a written notification will be sent to the study abroad consulting service provider, specifying the reasons.
Step 5: The Department of Education and Training will issue a decision to grant the Enterprise Registration Certificate for study abroad consulting services - the License for study abroad consulting for the organization.
