According to Clause 1, Article 1 of Resolution 93/2015/QH13 and Article 70 of the Law on Social Insurance 2024:
- Normally, an employee must wait at least 12 months from the date of resignation and without continuing to pay social insurance contributions before they are eligible to submit an application for a lump-sum social insurance benefit.
- In exceptional cases (where social insurance participation has been terminated and a request is made, the person is entitled to receive the lump-sum social insurance benefit): reaching retirement age; emigrating abroad for permanent residence; suffering from a life-threatening illness (such as cancer, polio, HIV at the AIDS stage, etc.); or for military or police personnel upon demobilization or discharge from service.
⇔ Conclusion: Since you have only been off work for 3 months and do not fall into any of the exceptional cases, you cannot withdraw the lump-sum social insurance benefit at this time.
