There are currently 7 arbitration centres in Vietnam, namely:

 Could parties bring a dispute to VIAC if there is no arbitration agreement?

In accordance with Article 5 of The Arbitration Law 2010, an arbitration agreement is required if the parties wish to resolve dispute by arbitration. The arbitration agreement may be established before or after the dispute had arisen.

In order to submit a request for arbitration to VIAC, the arbitration agreement have to indicate clearly the will of parties to select VIAC to resolve the dispute.

The Vietnam International Arbitration Centre at the Vietnam Chamber of Commerce and Industry (the “VIAC”) recommends that all parties wishing to make reference to VIAC arbitration in their contracts use the following model clause.

“All disputes arising out of or in relation to this contract shall be finally settled by the Vietnam International Arbitration Centre at the Vietnam Chamber of Commerce and Industry in accordance with its Rules of Arbitration”.
