Dantri.com, A company in Guazhou (China) have just had the exclusive protection of two trademarks "Buon Ma Thuot Coffee, 1896 and image" and "Buon Ma Thuot and 3 Chinese words" in the territory of this country for 10 years. It leads to difficulty for coffee export of Vietnam into Chinese market. The question is how to ask for this geographical identification.
Lawyer Pham Duy Khuong, S&B Law Company gave his opinion as follows:
“…According to Article 16 of Trademark Law of China, “the biggest problem in asking for the trademark return is time". In particular, Article 16 stipulates (translated): "With the trademark contains geographical identification which does not have the origin from the mention geographical place, causing confusion for public about the true origin, shall be rejected and banned to use”
