Question:

I received information from the Facebook page “Government Information” stating that: “The Politburo: November 24 is selected as Vietnamese Culture Day, employees are entitled to a paid day off.” May I ask whether this information is accurate? If so, when will it take effect and what is the scope of its application?

Answer:

The above information is completely accurate. On January 7, Resolution No. 80-NQ/TW of the Politburo on the development of Vietnamese culture was promulgated. In Section III, Item 3, the Resolution clearly states:“It is agreed to select November 24 every year as ‘Vietnamese Culture Day’, with the policy that it shall be a day off with full pay for employees, in order to enhance the public’s access to cultural enjoyment, encourage artists and cultural practitioners to create, and promote a cultured and civilized lifestyle throughout society.”

However, a Resolution is understood as a form of decision-making document that addresses fundamental issues after being discussed and adopted by majority vote at a meeting, expressing the viewpoint or intention of a competent authority or organization on a specific matter. In simple terms, this Resolution reflects the policy orientation and intention of the Politburo. In order for this Resolution to be implemented, it must be institutionalized through legal normative documents, such as implementing decrees. At present, since the Resolution has only recently been issued, there are no implementing decrees or guiding regulations yet. Therefore, there is currently no specific effective date or defined scope of application. Accordingly, employees shall continue to work as usual until the National Assembly officially amends the law and the Government issues detailed implementing regulations.
