Question:

I would like to receive foreign interns from an overseas university to work at my company for a period of 2 months. Do I need to carry out any procedures?

Answer:

According to Clause 7, Article 7 of Decree No. 219/2025/ND-CP:

Foreign students, trainees, or interns who are studying at educational institutions in Vietnam or abroad and have an internship agreement or an invitation letter to work for an employer in Vietnam; as well as interns or trainees working on Vietnamese vessels, fall under the category of foreign workers not required to obtain a work permit.

Therefore, you must carry out the procedure for Obtaining a Certification that the Foreign Worker Is Not Required to Obtain a Work Permit.

Accordingly, the following documents need to be prepared:

  • A written request for the Certification of exemption from the work permit requirement, using Form No. 01 of the Appendix issued together with Decree No. 219/2025/ND-CP.
  • A health certificate issued by a qualified medical establishment, except where health examination results have already been connected and shared on the national medical information system or the national healthcare database. A health certificate issued by a competent foreign medical authority may be used if Vietnam and that country or territory have a treaty or mutual recognition agreement, and the certificate is valid for no more than 12 months from the date of issue.
  • Two color photos (4 cm x 6 cm, white background, front-facing, bareheaded, without glasses).
  • A valid passport.
  • Documents proving that the foreign worker is exempt from the work permit requirement, which include one of the following:

– A document issued by a competent authority as prescribed by law.
