Question: I am USA citizen and would like to have some question as follows:

What kind of visa should I apply from my country? Tourist visa or business visa? Can your law firm help me to apply or send me documents to obtain visa?

 

What kind of company can I register on my business visa? Import/export, trading, real estate, tourism services,restaurant?or I can list  under the name of my company all the activities mentioned and more activities?

 

How much is the cost to register such company along with your law office services?

 

How much should I deposit in bank so I can register the company?

 

Can I rent an office for my business and recruit employees and how many can I recruit?

 

As a business man, do I have to stay all the time in Vietnam or I can travel whenever I want as long I have a house rented under my name?

 

Can I do external transfers from my account to my country Lebanon to individual/family members ?

 

As Lebanese can I obtain once I register company a permanent visa?

 

As Lebanese can I buy real estate/land/car under my name?

 

Do I pay taxes on goods that I import and how much?

1. What kind of visa should I apply from my country? Tourist visa or business visa? Can your law firm help me to apply or send me documents to obtain visa?
Depending on purpose of your visit to Vietnam, you can consider obtaining tourist visa or business visa. If you visits Vietnam for business purpose, business visa is highly recommended. However, please note that, in order to obtain business visa, in this case, you must have invitation letter from a company duly established and operating in Vietnam.
 
We do not support Client in obtaining Visa. Generally, Client shall contact tourist visa for support in obtaining Visa.
 
2. What kind of company can I register on my business visa? Import/export, trading, real estate, tourism services,restaurant?or I can list  under the name of my company all the activities mentioned and more activities?
Form of company possible established under your name in Vietnam does not depend on what kind of visa that you have. It shall very much depend on your nationality, your experience and financial ability. In theory, you can establish the company for import/export, trading, real estate, tourism, restaurant, computer etc.. Upon receipt of your application dossier for setting up company, competent authority in Vietnam shall carefully review whether you can satisfy necessary conditions for carrying out business activities in such registered business lines. For example, if you want to carry out real estate business in Vietnam, you must invest at least 1,000,000 USD to setup the company. In another case, if you wish to carry out tourism service, you must joint venture with a Vietnamese Company which was already licensed to provide international tourism service.
Generally, according to our practical experience, you should focus on one or three main business activities that you are really interested to secure the success possibility.
3. How much is the cost to register such company along with your law office services?
Our service fee for establishing a company in Vietnam shall very much depend on complication of each case. Our minimum fee is 4,000USD. The fee is exclusive of 10% VAT, actual cost for translating your documents from English into Vietnamese (10USD/150 words) and traveling cost if you require us to move out Hanoi or Ho Chi Minh City to support you.
 
4. How much should I deposit in bank so I can register the company?
 
During registering company in Vietnam, you shall be required to provide evidence proving that you have enough financial ability to perform capital contribution. Then, the deposit amount in your bank account must be at least equivalent to amount of capital that you intend to invest into Company in Vietnam. You do not need to block such deposit in your bank account.
 
5. Can I rent an office for my business and recruit employees and how many can I recruit?
 
Yest, you can. There is no limitation on number of employee to be recruited.
6. As a business man, do I have to stay all the time in Vietnam or I can travel whenever I want as long I have a house rented under my name?
No, you do not need to stay all time in Vietnam. You can travel whenever you want.
7. Can I do external transfers from my account to my country Lebanon to individual/family members ?
Yes, you can.
 
8. As Lebanese can I obtain once I register company a permanent visa?
No. You can obtain a multiple business visa or a temporary residence permit having maximum term of 5 years (extendable).
 
9.  As Lebanese can I buy real estate/land/car under my name?
Yes, if you can obtain 90 days visa to enter into Vietnam, you can purchase an apartment/house in an approved real estate project. You can own such apartment/house in 50 years. Term of ownership can be extendable.
10. Do I pay taxes on goods that I import and how much?
Import duty shall be depended on what kind of imported goods and origin of imported goods. Goods imported from countries having bilateral agreement on free trade with Vietnam can enjoy preferred Import Duty.
11. Does the government charge me at the end of the year taxes on my trading and profit activity?
Yes. You shall have to pay tax monthly or quarterly for profit obtained from your trading activities in Vietnam.
12. In case I marry a Vietnamese,is it more easy to open a business in Vietnam and register a company?
No. It shall only help you to obtain a 5 years multiple entry visa.
13. What does she benefits in case we divorce later on or we can sign papers at lawyer that she will benefits of a certain amount of money before we marry.
Generally, your spouse can have a share of 50% total asset incurred during your marriage. The court can take account contribution of each person into assets incurred during your marriage. Premarital agreement has not yet been recognized in Vietnam.
