Who Has the Right to Register an Industrial Design?

According to Article 86 of the Intellectual Property Law, the right to register an industrial design belongs to:

  • The creator of the design, if they developed it using their own effort and resources.
  • The organization or individual that provided financial and material support for the design’s creation.
  • Groups of individuals or organizations who co-invested or co-created the design (registration is valid only if all parties agree).
  • Transfer of registration rights: The rightful owner can transfer the registration right through a contract or inheritance.

Where to Submit the Application?

Businesses or individuals can submit industrial design registration applications to the Intellectual Property Office of Vietnam (NOIP) via direct submission or postal mail to the following addresses:

  • Head Office: 386 Nguyễn Trãi, Thanh Xuân District, Hanoi.
  • Representative Office in Ho Chi Minh City: 7th Floor, Hà Phan Building, 17/19 Tôn Thất Tùng, Phạm Ngũ Lão Ward, District 1, Ho Chi Minh City.
  • Representative Office in Da Nang: 3rd Floor, 135 Minh Mạng, Khuê Mỹ Ward, Ngũ Hành Sơn District, Da Nang.

Required Documents for Industrial Design Registration:

  • Industrial Design Registration Form: Form No. 07, Appendix 1 attached to Decree No. 65/2023/NĐ-CP.
  • Set of photographs or drawings: Clearly showing multiple views of the product.
  • Industrial Design Description: Detailed explanation of the design’s nature, consistent with the provided images or drawings.
  • Proof of fee payment: Receipt or payment confirmation for related fees.
  • Power of Attorney: If applying through an intellectual property representative.
