On May 16, 2024, the Government issued Decree No. 55/2024/ND-CP detailing a number of articles of the Law on Consumer Rights Protection.
Some outstanding contents of the Decree are as follows:
- Responsibilities of individuals conducting independent and regular commercial activities without having to register their business within markets and commercial centers; Responsibilities of organizations managing markets and commercial centers.
- Contracts concluded with consumers, form contracts, general transaction conditions. Form contracts and general transaction conditions are only used to conclude or apply to consumers when registration is completed according to regulations.
- Responsibilities of organizations and individuals for defective products and goods: Necessary measures to stop providing defective products and goods; Responsibility to publicize and publicly announce the recall of defective products and goods;
- Responsibilities of business organizations and individuals towards consumers in specific transactions: Responsibilities of business organizations and individuals in remote transactions; Responsibilities of organizations establishing and operating large digital platforms; Responsibilities of multi-level marketing organizations and individuals...
- Compensation for damages in civil cases on protecting consumer rights brought by social organizations in the public interest.
This Decree takes effect from July 1, 2024.
