(S&B Law) In the Intellectual Property program of Security Television (ANTV), Lawyer Nguyen Thanh Ha, Managing partner of S&B Law Limited Liability Company (S&B Law) answered the questions of the editor on the status of intellectual property right violation and the warning for the violators.
Lawyer Nguyen Thanh Ha thinks that the violation of intellectual property right is popular in fake products and imitates as well as the breach of trademark and industrial design.
For the product to be released to the market, the owners have to invest many resources. However, some individuals and organizations may violate the intellectual property rights such as trademark/brand, which brings the damages to the manufacturers and society.
A typical example is the fake helmets with harmful influence to the health and safety of the people, and the manufacturers may lose the market share.
Additionally, Lawyer Nguyen Thanh Ha, also warned these organizations and individuals that they may face the administrative, civil or criminal responsibility. The highest cap for the administrative violation in intellectual propert is 500 million dong.
For the manufacturers, when identifying the violation, need to have the urgent settlement, with intellectual property agency and government authority.
