I am Lawyer of SB Law. I was entrusted to provide you legal advice regarding to setting up foreign owned Cleaning & Maintenance company in Vietnam.
Under Vietnam Law, in order to setup foreign owned company, you must firstly obtain Investment Registration Certificate. Possibility for obtaining this Investment Registration Certificate shall very much depend on internal law of Vietnam and International Treaties that Vietnam is a contract party. In this case, you intend to conduct business in Cleaning and Maintenance service.
- Under Vietnam's WTO Commitment, foreign investor is entitled to setup 100% foreign owned company for providing maintenance service, except for maintenancing transportation vehicles.
- For Cleaning service, under Vietnam's WTO Commitment, Vietnam does not commit to open market on cleaning service to Foreign Investor. Then, possibility for granting you license for conducting cleaning service shall very much depend on sole direction of Vietnam Government. Fortunately, under ASEAN FRAMEWORK AGREEMENT ON SERVICE, Vietnam Government commit to open market for this service to investors from country member of ASEAN.
Then, if you are really interested in setting up foreign owned company carrying out cleaning and maintenance service in Vietnam, you can consider use of a Singaporean Company to act as parent company to setup the same. This shall help you to enhance your success possibility.
If you use a company from a country member of ASEAN for setting up cleaning and maintenance company in Vietnam, our service fee shall be 4,000USD and it shall take you 20 working days from submission application dossier to the competent authority to complete the licensing work. If you use company from countries other than country member of ASEAN to setup cleaning and maintenance company in Vietnam, our service fee shall be 5,500USD and it shall take you 45 working days from submission application dossier to the competent authority to complete the licensing work.
Above said service fee is exclusive of VAT: 10%, actual cost for translating your documents from English into Vietnamese: 10USD/150 words and actual expense for traveling out of Hanoi or Ho Chi Minh City if you wishes to setup company in provinces/cities other than HN or HCM.
