Question: I am a representative of an agency in charge of the investment preparation and site clearance for the North – South high-speed railway project. I am aware that the Government has just promulgated a new resolution on adjusting the implementation method of this project. Please advise on the specific contents of this regulation, its impact on the schedule, the risks our entity may face if we continue using outdated dossiers, and the immediate actions required.

Answer:
1. Main contents: Resolution 98/NQ-CP (effective from April 06, 2026) regulates the implementation of the high-speed railway Project on the North – South axis, with the following core contents:
- Separating compensation, support, and resettlement: Allowing the separation of the compensation, support, and resettlement contents of the North – South high-speed railway Project into independent projects.
- Amending implementation appendices: Amending the contents of Appendix I and Appendix II of the previous Resolution 106/NQ-CP.
(Pursuant to Article 1, Clause 1 Article 2 and Article 3 of Resolution 98/NQ-CP)
2. Greatest impacts
This regulation helps accelerate the site clearance and investment preparation phase for large-scale infrastructure projects.
3. Risks of non-compliance
- Risks when the investment preparation and site clearance dossiers still adhere to the old appendices.
- Leading to incorrect implementation tasks, causing bottlenecks and delays in the overall schedule.
(Pursuant to the List of 17 projects in Appendix I of Resolution 98/NQ-CP)
4. Proposed action plans
- Immediately updating the new implementation appendices in accordance with Resolution 98/NQ-CP.
- Quickly separating the compensation, support, and resettlement tasks into independent projects to closely follow the schedule.
(Pursuant to Article 2, Appendix I and Appendix II of Resolution 98/NQ-CP)
5. Notes and recommendations
- Maximizing specific mechanisms to shorten procedures: The unit needs to immediately apply the permitted powers such as not being required to approve the investment policy, formulating and deciding on the project investment based on the preliminary design, as well as using the form of direct contracting or limited bidding. This helps to completely reduce administrative stages, accelerating the progress of contractor selection and investment preparation.
- Proactively receiving boundary markers and proposing funding sources: It is recommended that the unit closely follow the Investor to receive the handover of dossiers and boundary markers on the field in order to soon commence the site clearance work. At the same time, a plan to determine the capital demand needs to be immediately formulated to report to the competent authority for timely annual budget allocation, avoiding the situation where the project is delayed due to the interruption of the compensation cash flow.
