In 2011, my Company was granted the Certificates of Land Use Rights and Ownership of Houses and Other Land-Attached Assets for a plot located in the High-Tech Land Area where our current factory is situated. However, in 2024, due to administrative boundary changes, the current address of this plot has changed from the address recorded in the Certificate. If my company wants to change the address on the granted Certificate, what procedures must be followed?
Answer:
1. In case your Company wants to change the address on the Certificates of Land Use Rights and Ownership of Houses and Other Land-Attached Assets that has been issued, the Company must comply with the provisions at Point h, Clause 1, Article 38 of Decree 101/2024/ND-CP as follows:
“1. Cases of reissuing the issued Certificate:
…
h) Changing the address of the land plot that has been issued a Certificate;
…”
Thus, to change the address on the Certificate, your Company must carry out the procedure for requesting a reissuance of the issued Certificate. The order and procedures for reissuing the issued Certificate will be carried out as follows.
2. The dossier to be submitted for reissuing the granted Certificate includes:
- Application for registration of changes in land and assets attached to land according to Form No. 11/DK issued with Decree 101/2024/ND-CP and the issued Certificate;
- Enterprise Registration Certificate for each change: Photocopy;
- The most recent valid Enterprise Registration Certificate: Original + Notarized copy;
- Investment Registration Certificate: Original + Notarized copy;
- Authorization letter for the person submitting the dossier.
Thus, when preparing the dossier to be submitted when carrying out the procedure for reissuing the issued Certificate, the Company needs to pay attention to preparing documents corresponding to each specific requirement to avoid errors and wasting time to supplement.
3. The process and procedure for reissuing the granted Certificate:
- The Company submits the dossier outlined in point 2 to the competent Land Registration Office for processing.;
- The receiving authority will issue a receipt for the dossier and schedule a date to return the result;
- Estimated time: 2-3 weeks.
Note: All procedures for reissuing the issued Certificate (Submitting Documents, Supplementing, Receiving Results, etc.) must be carried out directly at the Land Registration Office. Therefore, in case the Company authorizes an individual to carry out the above procedures, the Company needs to prepare a power of attorney attached to the registration file for re-issuance.
Therefore, your Company needs to prepare the Dossiers and carry out the above procedures to be reissued the issued Certificate in accordance with the provisions of law.
