The patent registration process in Vietnam consists of the following steps:
- Filing the patent application at the Intellectual Property Office of Vietnam (IP Vietnam). The office examines the formal validity of the application within 1-2 months.
- Formal examination (1-3 months from the filing date): The application and accompanying documents are reviewed for compliance. If all requirements are met, a notice of acceptance is issued.
- Publication of the application (19 months from the filing date): If no early publication request is made, the invention details are published in the Industrial Property Gazette.
- Substantive examination:
- If a request for substantive examination is filed before the publication date, the examination takes place within 18 months from the publication date.
- If the request is filed after the publication date, the examination starts from the date of the request submission.
- The examination determines whether the invention meets the patentability criteria. If approved, a notification of patent grant is issued.
- Payment of patent granting fees: The applicant must pay the granting fees within 3 months from the date of the grant decision.
6. Patent grant (1-3 months from fee payment): The patent is issued and officially published in the Industrial Property Gazette.
