Question: I am curious as to whether or not I am eligible for these same benefits? My employees are trying to tell me that I am not eligible to overtime on a holiday weekend or overtime during the week for teaching hours that exceed my contract. From my research on the labor code that doesn't appear true.
What is the process for fighting this situation and what investment (time + money) would be necessary to fight it?
Answer:
Under Vietnam Labour Code, an employer may request an employee to work overtime upon obtaining the employee’s consent. In case employee want to overtime work, you must also be approved by the employer. Therefore, overtime issue shall depend on the negotiation between employer and employee.
