Subjects Eligible for Patent Protection
Patent protection applies to technical solutions, which may fall into the following categories:
- Products:
- Physical products: Includes tools, machines, equipment, components, electrical circuits, etc. These products are defined by their technical structure and design, enabling them to perform specific functions that meet human needs.
- Chemical products: Includes materials, compounds, food, pharmaceuticals, etc. These products are composed of specific chemical ingredients in defined proportions and states, serving purposes such as construction, healthcare, and nutrition.
- Biological products: Includes genetically modified genes, plants, and animals. These products contain genetically modified information and possess the ability to self-replicate.
- Processes or Methods:
- These include a sequence of steps used to perform a specific process or task. They are defined by detailed procedural information, including execution order, involved elements, applied measures, and supporting tools.
- These processes can be applied in fields such as manufacturing, diagnostics, forecasting, inspection, and treatment to achieve optimal and efficient results.
Subjects Not Eligible for Patent Protection
According to Article 59 of the Intellectual Property Law, the following are not eligible for patent protection:
- Discoveries, scientific theories, and mathematical methods.
- Diagrams, plans, rules, and methods for performing mental activities, training animals, playing games, and conducting business; computer programs.
- Methods of presenting information.
- Solutions that only have aesthetic value.
- Plant varieties and animal breeds.
- Processes for producing plants and animals that are primarily biological in nature (excluding microbiological processes).
- Methods for disease prevention, diagnosis, and treatment in humans and animals.
