It is proposed that the draft Law amending the Land Law 2024, Housing Law 2023, Real Estate Business Law 2023, and Credit Institutions Law 2024 will have two options:
- Option 1: The draft Law will consist of 5 articles
Article 1. Amendment to Article 252, Clause 1 of the Land Law No. 31/2024/QH15 as follows:
"This Law shall enter into force on August 1, 2024, except for the provisions of Clause 2 and Clause 3 of this Article. Articles 253; Article 254 (except for Clause 4 and Clause 5); Article 255 (except for Clause 8); Article 256 (except for Clause 2 and Clause 4); Article 257 (except for Clause 1); Article 258; Article 259; Article 260 (except for Clauses 12, 14, and 15) of the Land Law shall enter into force on January 1, 2025."
Article 2. Amendment to Article 197, Clause 1 of the Housing Law No. 27/2023/QH15 as follows:
"This Law shall enter into force on August 1, 2024."
Article 3. Amendment to Article 82, Clause 1 of the Real Estate Business Law No. 29/2023/QH15 as follows:
"This Law shall enter into force on August 1, 2024."
Article 4. Amendment to Article 209, Clause 2 of the Credit Institutions Law No. 32/2024/QH15 as follows:
"Clause 3 of Article 200 and Clause 15 of Article 210 of this Law shall enter into force on August 1, 2024."
Article 5. Entry into force
This Law shall enter into force on... [specify date and month], 2024.
- Option 2: The draft Law will consist of 6 articles
Article 1. Amendment to Article 197, Clause 1 of the Housing Law No. 27/2023/QH15 as follows:
"This Law shall enter into force on August 1, 2024."
Article 2. Amendment to Article 82, Clause 1 of the Real Estate Business Law No. 29/2023/QH15 as follows:
"This Law shall enter into force on August 1, 2024."
Article 3. Amendment to Article 252, Clause 1 of the Land Law No. 31/2024/QH15 as follows:
"This Law shall enter into force on August 1, 2024, except for the provisions of Clause 2 and Clause 3 of this Article."
Article 4. Amendment to Article 209, Clause 2 of the Credit Institutions Law No. 32/2024/QH15 as follows:
"Clause 3 of Article 200 and Clause 15 of Article 210 of this Law shall enter into force on August 1, 2024."
Article 5. Transitional provision
Entities and individuals related to transitional provisions stipulated in Housing Law No. 27/2023/QH15, Real Estate Business Law No. 29/2023/QH15, Land Law No. 31/2024/QH15 are allowed to choose to implement the provisions starting from January 1, 2025, or from August 1, 2024.
