Draft Decree Amending and Supplementing Decree No. 45/2022/ND-CP on Administrative Penalties for Environmental Protection Violations

The draft Decree proposes several new provisions, including:

- Updating Authorized Positions: Revising the list of officials with the authority to impose penalties and issue administrative violation reports. This update accounts for changes in the organizational structure of the agencies responsible for specialized inspections, including the Ministry of Public Security and the Ministry of Natural Resources and Environment.

- Amending Articles 45 and 46: Revising Article 45 on violations related to greenhouse gas emission reduction and Article 46 on violations regarding ozone layer protection to align with the draft Decree amending Decree No. 06/2022/ND-CP.

- Incorporating New Violations: Updating the draft to include new violations that reflect the legal responsibilities of organizations and individuals as outlined in Decree No. 08/2022/ND-CP and the Circulars guiding the implementation of the Environmental Protection Law of 2020.

- Adding Article 26a: Introducing Article 26a on violations related to the classification, collection, transportation, burial, disposal, burning, and treatment of municipal solid waste. This article separates these violations from Article 26 on ordinary solid waste to ensure compliance with the Environmental Protection Law of 2022.

- Aggravating Circumstances: Adding provisions for applying aggravating circumstances to repeat administrative violations.

- Transitional Provisions: Including provisions for facilities that have already received environmental protection plans under the Environmental Protection Law of 2014.
