Question:
Our company has been granted a liquor distribution license. Currently, we are selling liquor by bottle to individual customers and retail stores, without opening bottles to sell by the glass, as in bars. Is this business model in compliance with the contents of our license? With our existing liquor distribution license, are we allowed to sell directly to individual customers?
Answer:
Based on the information and documents provided by your company, SB Law confirms that you have been granted a liquor distribution license by the Ministry of Industry and Trade. According to this license, your company is classified as a liquor distributor and is authorized to conduct distribution activities in Hanoi and Ho Chi Minh City.
Pursuant to Point d, Clause 2, Article 18 of Decree No. 105/2017/ND-CP on liquor trading, as amended and supplemented by Point d, Clause 11, Article 16 of Decree No. 17/2020/ND-CP, liquor distributors are permitted to directly sell liquor at their business locations within the licensed provinces and centrally governed cities.
Therefore, your company is fully entitled to carry out retail liquor sales at retail establishments established by your company within the licensed areas. However, to ensure compliance with current legal regulations, your company must complete the business location registration procedures with the Business Registration Office where the retail establishments are located.
