Currently, our company owns a commercial service apartment, which has been granted a Certificate of Land Use Rights, Ownership of Residential Housing, and Other Assets Attached to the Land. When the owner wishes to carry out renovations in the commercial area, is it necessary to obtain approval from the Investor or the Apartment Management Board?

 Answer:
When the owner of a condominium unit wishes to carry out repairs, renovations, or install additional equipment or household items in the portion of the property that is privately owned, they are required to notify and seek the opinion of the Building Management Board. The Building Management Board is the unit authorized by the Investor to manage and supervise all activities within the building, including repairs, renovations, or upgrades carried out by residents. Seeking approval is not merely an administrative procedure but a necessary step to ensure that all renovation and installation works are conducted safely, in accordance with regulations, and to minimize any negative impacts on other residents and the common structure of the building.



Typically, the notification and approval process is clearly stipulated in the building’s internal regulations and operational management rules. Upon receiving the notification, the Management Board will directly supervise the entire construction process, including, but not limited to: construction schedule, methods and timing of transporting materials and equipment, as well as measures to minimize noise, dust, and other disturbances to neighboring residents and tenants. These measures are necessary to ensure that individual works do not disrupt the daily life, business activities, or living conditions of other residents in the building.

Moreover, the Management Board is responsible for assessing whether the scope of repair or installation may have a direct or indirect impact on the building’s common structure, technical systems, shared facilities, or common living spaces. In cases where the renovation or installation may negatively affect the structure or reduce the quality of communal use, the Management Board has the right to refuse or request adjustments to the scope or method of construction.

Therefore, notifying and seeking the opinion of the Building Management Board before carrying out any repairs, renovations, or installations in the unit not only protects the rights of the unit owner but also ensures safety, order, and the collective rights of all residents in the building, while facilitating a smooth, transparent, and legally compliant execution of the works.
