Question: My company intends to organize a promotional program to increase sales. What key points do we need to pay attention to?

Answer:
Pursuant to Article 3 of Decree No. 81/2018/ND-CP, when implementing a promotional program, the Company should take note of the following principles:

1.Legality and Transparency
Promotional programs must be conducted lawfully, honestly, publicly, and transparently, ensuring the legitimate rights and interests of consumers and other related organizations or individuals.

2.Ensuring the Rights of Prize Winners
The trader implementing the promotion must create favorable conditions for prize winners to receive their prizes and is responsible for resolving any complaints related to the promotional program (if any).

3.Quality Assurance
The trader must ensure the quality of goods or services being promoted, as well as goods or services used as promotional gifts or prizes.

4.Conditions for Promotion

a)The trader must not impose conditions requiring customers to renounce or refuse goods/services of other traders to be eligible for the promotion.

b)The trader must not directly compare its goods/services with those of other traders or individuals in the promotional content.

5.Prohibition on Using Lottery Results
Lottery results must not be used to determine prize winners or as a basis for awarding prizes in promotional programs.
