I have just had my labor contract terminated at a local enterprise. What conditions do I need to meet to receive unemployment benefits?
Employees who are contributing to unemployment insurance in accordance with the law may be entitled to unemployment allowance pursuant to the provisions of Article 38 of the Employment Law 2025, if they fully meet the following conditions:
- Termination of the labor contract, work contract, or cessation of work in accordance with the law, and not falling into any of the following cases: the employee unilaterally terminates the labor contract unlawfully as prescribed by the Labor Code, or the employee resigns when eligible for a pension.
- Has contributed to unemployment insurance for at least 12 months within the 24 months prior to the termination of the labor contract, work contract, or cessation of work in accordance with the law.
In the case of employees working under a labor contract with a term of at least 01 month but under 12 months, they must have contributed for at least 12 months within the 36 months prior to the termination of the labor contract.
- Has submitted a complete application for unemployment benefits within 03 months from the date of termination of the labor contract, work contract, or cessation of work.
- Within 10 working days from the date of submitting a complete application for unemployment benefits, the employee does not fall into any of the following cases: having employment and being subject to compulsory social insurance participation as prescribed by the Social Insurance Law, or performing military service, service in the People's Public Security, regular militia, studying for a fixed term of more than 12 months, complying with a decision to be sent to a compulsory education facility, compulsory rehabilitation facility, being in temporary detention, serving a prison sentence, emigrating abroad, or death.
ó Therefore, to be entitled to unemployment benefits, you need to fully meet the above 4 conditions.
