Periodic Reporting Regime for Industrial Clusters from October 1, 2024

On August 15, 2024, the Minister of Industry and Trade issued Circular 14/2024/TT-BCT, which regulates the periodic reporting regime for industrial clusters, the national industrial cluster database, and several forms for managing and developing industrial clusters.

Accordingly, the periodic reporting regime for industrial clusters is specifically regulated as follows:

  • Entities required to implement the periodic reporting regime:

+ Departments of Industry and Trade of provinces and centrally managed cities (referred to as Departments of Industry and Trade);

+ District-level People's Committees;

+ Investors in the construction of industrial cluster infrastructure;

+ Organizations and individuals investing in production and business activities within industrial clusters.

  • Deadline for closing periodic report data:

+ The deadline for closing data for the 6-month report (beginning of the year) is from December 15 of the year preceding the reporting period to June 14 of the reporting period;

+ The deadline for closing data for the annual report is from December 15 of the year preceding the reporting period to December 14 of the reporting period.

  • Implementation of the periodic reporting regime:

+ Periodically before June 20 and before December 20 each year, organizations and individuals investing in production and business activities within industrial clusters must report the operational status of the investment project within the industrial cluster for the past 6 months and the entire year, according to Form No. 01 in Appendix I attached to Circular 14/2024. Reports should be sent to the district-level statistical agency and concurrently to the district-level People's Committee;

+ Periodically before June 20 and before December 20 each year, investors in the construction of industrial cluster infrastructure must report the operational status of the infrastructure construction investment project within the industrial cluster for the past 6 months and the entire year, according to Form No. 02 in Appendix I attached to Circular 14/2024. Reports should be sent to the district-level statistical agency, the district-level People's Committee, and the Department of Industry and Trade;

+ Periodically before June 25 and before December 25 each year, district-level People's Committees must report the status of industrial clusters within their jurisdiction for the past 6 months and the entire year, according to Form No. 03 in Appendix I attached to Circular 14/2024. Reports should be sent to the provincial-level People's Committee and the Department of Industry and Trade;

+ Periodically before June 30 and before December 31 each year, the Department of Industry and Trade must report the status of industrial clusters within the province for the past 6 months and the entire year, according to Form No. 04 in Appendix I attached to Circular 14/2024. Reports should be sent to the provincial-level People's Committee and the Ministry of Industry and Trade (Local Industry and Trade Agency).

  • Methods of sending and receiving periodic reports:

+ Periodic reports can be in the form of paper documents or electronic documents and can be sent to the receiving agency through one of the following methods: direct submission, postal service, national document interconnection system, email, or other methods as prescribed by law.

+ If the national industrial cluster database has been developed and is operational, the Department of Industry and Trade shall submit periodic reports to the Ministry of Industry and Trade (Local Industry and Trade Agency) through data updates and report submissions via the national industrial cluster database.

The Circular takes effect from October 1, 2024.
