S&B Law would like to provide some information about benefits of employee under the Vietnam labor law for your kind reference:

Public Holiday

New Year Day (1st January of each Year): 01 day

- Five days for the Lunar New Year festival which shall include the last day of the lunar year and the first four days of the new lunar year. The dates of these holidays may vary from year to year;

- One day for Hung King Anniversary Day - March 10 of the Lunar Year

- One day on the occasion of Victory day - April 30

- One day on the occasion of Labor day - May 1st

- One day on the occasion of National Day - September 2

Working hours

8 hours/01 day/ 48 hours/01 week

- Breaking time: 30 minutes. This shall be included in the working hours.

- Overtime: The overtime hours shall be to a maximum of four hours per day, and 200 hours per year.

- Weekly break: Sunday or Saturday and Sunday.

Annual Break

The employee who has completed one year i.e. 12 months’ service in the company shall be entitled to an annual leave of 12 days with full pay.

For an employee who has completed more than five years of service in the company, there shall be a proportionate increase of one day holiday for every five years of service.

The employee with less than 12 months’ service also shall be entitled to an annual leave but the number of days shall correspond with the length of his/her employment.

Personally Paid Leaves

- Three days for one’s own marriage;

- One day for marriage of one’s son or daughter

- Three days in case of death of the parent, parent-in-law, spouse, son or daughter;

- One day in case of death of the grandparent, siblings

- Male Employee is entitled to 01 day off in case of his wife’s giving birth

Maternity Leave

The female employee is entitled to maternity leave before and after child birth, for 6 months.

Overtime and working at night Salary

The employee who works overtime is paid according to his salary as following

a.       150% on week days.

b.      200% on weekly days-off

c.       300% on holidays and days-off with pay as well as a compensatory day-off

The employee working overtime at night shall be entitled to an additional payment of 30% of the salary of work done in the day time.

Compulsory Social Insurance:

- Employer: 17% of salary paid to Employee. From 1st January 2014, this portion shall be 18%.

- Employee: 7% of salary. From 1st January 2014, this portion shall be 8%. This amount shall be deducted from gross salary.

Compulsory Health Insurance:

Employer: 3% of salary paid to Employee.

- Employee: 1 % of salary. This amount shall be deducted from gross salary.

Unemployment Insurance:

Employer: 1% of salary paid to Employee.

- Employee: 1 % of salary. This amount shall be deducted from gross salary.
