Amendment of Decrees Guiding the Law on Investment in the Form of Public-Private Partnership

On September 13, 2024, the Government Office issued Official Dispatch 6549/VPCP-CN 2024 regarding the Decree amending several Decrees guiding the Law on Investment in the form of Public-Private Partnership (PPP).

Accordingly, based on the proposal of the Ministry of Planning and Investment regarding the drafting of the Law amending and supplementing several provisions of the Law on Investment in the form of Public-Private Partnership (PPP) and the proposal from the Ministry of Finance regarding the amendment and supplementation of certain articles of the Decree detailing and guiding the implementation of the Law on Investment in the form of PPP, Deputy Prime Minister Trần Hồng Hà has agreed with the recommendations from the Ministry of Planning and Investment to proceed with the development of Decrees amending Decree No. 35/2021/NĐ-CP dated March 29, 2021, and Decree No. 28/2021/NĐ-CP dated March 26, 2021, in parallel with the process of developing and finalizing amendments to the Law on Planning, the Law on Investment, the Law on Investment in the form of PPP, and the Law on Bidding.

The Ministry of Finance will coordinate closely with the Ministry of Planning and Investment in the process of developing and finalizing the amendments to the Law on Planning, the Law on Investment, the Law on Investment in the form of PPP, and the Law on Bidding to ensure that difficulties and obstacles related to Build-Transfer (BT) contracts, as reported by the Ministry of Finance, are addressed. The Ministry of Finance will continue reviewing and studying amendments to Decree No. 69/2019/NĐ-CP dated August 15, 2019, to resolve challenges related to BT contracts within the Government’s authority while simultaneously developing and finalizing the amendments to the Law on Planning, the Law on Investment, the Law on Investment in the form of PPP, and the Law on Bidding.
