Client has intention to engage a legal consultant on advices and implementation the procedures for amending the investment certificate in accordance with current Vietnam’s Laws;
SB Law is qualified for above mentioned requirements and is willing to advice Client regarding the above-mentioned works in accordance with current Vietnam’s Laws.
1. Scope of Services, means of services and services period
SB LAW is ready to provide legal consultation services as the following two phases:
Phase 1: Procedure on amending the Investment Certificate
Providing advices on all legal aspects relating to procedures on amending Investment Certificate from competent authority of Ho Chi Minh City;
Preparing the application dossiers (in both Vietnamese and English) for amending Investment Certificate;
Representing Client to submit the application dossiers to competent authority of Ho Chi Minh City;
Working with provincial competent authority of Ho Chi Minh City on behalf of Client to obtain the best support on reviewing and considering the application and providing explanation and/or supplementation of application dossiers per request;
Updating information of the approving process to Client;
Receiving amended Investment Certificate from competent authority and hand it over to Client.
Phase 2: Post Licensing Procedure
Publishing the information of company on 3 consecutive newspapers as required by competent authority;
Submitting the Notification for changing of tax information.
2.Timing for amending
Within 01 (one) working day from singing contract between two parties, SBLaw shall deliver Client checklist of information and necessary documents for amending Investment Certificate;
Within 02 (two) working days from full receipt of information and necessary documents delivered by Client, SBLaw shall deliver Client the application dossiers for reviewing and proceeding;
Within 01 (one) working day from full receipt of duly signed document provided by Client, SB Law shall submit application dossiers to provincial competent authority of Ho Chi Minh City;
Within 25 (twenty-five) working days from duly submission of dossier to provincial competent authority, SBLaw shall obtain the amended Investment Certificate for the company;
Within 01 (one) working days from obtaining the amended Investment Certificate, SBLaw shall submit the Notification for changing of tax information;
Within 01 (one) working days from obtaining the amended Investment Certificate, SBLaw shall publish the information of company establishment on 3 consecutive newspapers.
