EXTRACURRICULAR EDUCATIONAL ACTIVITIES

Question: I am planning to organize a music class (piano/guitar, etc.) within the campus of a university. In order to legally carry out this extracurricular educational activity, what types of documents and applications do I need to prepare? Additionally, are there any specific legal considerations or special requirements I should be xa of when operating such a class within a university campus?
Answer:

Establishing a music class within a university campus is considered an extracurricular educational activity, aimed at providing music skills to students and the community. According to Circular No. 04/2014/TT-BGDĐT issued by the Ministry of Education and Training, this activity must meet certain conditions and be licensed by a competent authority.

1. Operational conditions

According to Articles 4, 5, and 6 of Circular No. 04/2014/TT-BGDĐT issued by the Ministry of Education and Training, to be permitted to open a music class for teaching musical instruments within a university, the class must meet the following conditions:

a. Facilities

- Classrooms and functional rooms must have sufficient lighting and meet the hygiene standards stipulated for educational institutions.

- Teaching equipment must be safe, suitable for the teaching content and activities, and appropriate for the psychological age of the learners.

b. Teachers

- Must be in good health.

- Must demonstrate good moral character, not be under disciplinary action at the level of warning or higher, and must not be under criminal investigation.

- Must hold a certificate in pedagogical training and possess relevant expertise in life skills or educational activities (such as a music qualification).

c. Curriculum and Teaching Materials

- The class must have sufficient curriculum and teaching materials issued or approved by the Ministry of Education and Training.

- If the curriculum or teaching materials are self-selected or self-developed, they must be approved by the competent authority responsible for granting the operational license or confirming the registration of activities. These materials must meet regulatory requirements, contain content consistent with Vietnamese cultural values and traditions, not violate any legal provisions.

2. Application documents for licensing

Once the above operational conditions are met, pursuant to Clause 2, Article 7 of Circular No. 04/2014/TT-BGDĐT, you must prepare the following application documents to request a license:

-       Application letter for licensing:
The letter must include:

(1)  Objectives, tasks, training programs, and content.

(2)  Information on land, facilities, equipment, location, organizational structure, finances, and other resources.

(3)  A commitment to ensuring security, order, environmental hygiene, and compliance with the regulations of the relevant management authorities.

- Business registration certificate

- List and brief resumes. This should detail: Full name, educational level, position, profession, pedagogical skills, and knowledge of life skills or related educational activities of the leadership, teachers, trainers, and instructors.

- Activity plan and curriculum.

3. Licensing authority: According to Clause 1, Article 7 of Circular No. 04/2014/TT-BGDĐT, the Principle of the university or college has the authority to grant licenses for extracurricular educational activities, including the music class to be established within the university premises.

Organizing a music class on a university campus is entirely feasible, provided that the required documents are submitted, and all conditions regarding facilities, personnel, and curriculum are met. It is also essential to obtain written approval from the university's president. Close cooperation with the university will play a key role in ensuring smooth implementation and full compliance with legal requirements.
