On May 4, 2024, the Government issued Decree No. 46/2024/ND-CP amending and supplementing a number of articles of Decree No. 99/2013/ND-CP dated August 29, 2013 of the Government regulating The Decision on sanctioning administrative violations in the field of industrial property has been amended and supplemented with a number of articles according to Decree No. 126/2021/ND-CP dated December 30, 2021 of the Government.
This Decree regulates a number of contents on sanctions for administrative violations in the field of industrial property, such as:
- Measures to prevent and ensure the handling of administrative violations
- Determine the value of evidence and means of violation as a basis for determining the fine frame and sanctioning authority
- Cases of violation of regulations on instructions for protection of industrial property rights and transfer of rights to use industrial property objects
- Cases of violation of regulations on sealing and temporary seizure of evidence and means of violation during the inspection and examination process
- Producing, importing, trading, offering for sale, storing for sale, displaying for sale, transporting goods with counterfeit trademarks or geographical indications that do not reach the level of criminal prosecution
- Determining sanctioning authority
- Procedures for sanctioning acts of infringement of industrial property rights
