Question: I am a representative of a social housing project developer and an individual customer who wishes to purchase a house. I understand that the Government has just issued Decree 136/2026/ND-CP relaxing income conditions. May I ask which core regulations we need to grasp, what are the risks of non-compliance, and what action plan is required?

GUIDELINES ON INCOME CONDITIONS AND SOCIAL HOUSING REGISTRATION PURSUANT TO DECREE 136/2026/ND-CP

Answer: Below is the detailed consultancy regarding the new regulations on the development and management of social housing (amending Decree 100/2024/ND-CP) pursuant to Decree 136/2026/ND-CP (effective from April 07, 2026):

  1. Main contents: Decree 136/2026/ND-CP raises the income ceiling for subjects eligible to purchase or lease-purchase social housing and issues new registration forms. Specifically:

- Income level for ordinary subjects:

+ Single persons: Monthly actual income not exceeding 25,000,000 VND.

+ Single persons raising minors: Not exceeding 35,000,000 VND.

+ Married persons: Total income of both husband and wife not exceeding 50,000,000 VND.

(Pursuant to Point a, b Clause 1 Article 30 Decree 100/2024/ND-CP as amended in Clause 1 Article 1 Decree 136/2026/ND-CP)

- Income level for Armed Forces:

+ Single persons: Not exceeding the total income of an officer with the rank of Colonel.

+ Married (both belonging to the Armed Forces): Not exceeding 2.0 times the total income of a Colonel.

+ Married (one person not belonging to the Armed Forces): Not exceeding the total income of a Colonel plus 25,000,000 VND.

(Pursuant to Clause 1, 2 Article 67 Decree 100/2024/ND-CP as amended in Clause 2 Article 1 Decree 136/2026/ND-CP)

- New registration form template: Amending Form No. 01 (Application for purchase, lease-purchase, or lease of social housing) in Appendix II to comply with the new income thresholds.

(Pursuant to Clause 3 Article 1 and Appendix of Decree 136/2026/ND-CP)

  1. Greatest impacts

Raising the income limits significantly expands the group of employees eligible to purchase social housing. This directly alters project dossiers, sales strategies, and the target audience of real estate developers.

  1. Risks of non-compliance

If the Developer or the home purchaser continues to use old application forms, or certifies incomes that incorrectly reflect the new thresholds (25 - 35 - 50 million VND): The registration dossier shall be returned by the management authority or requested for supplementation, causing delays in the purchase and sale progress.

  1. Proposed action plans

The Developer and transaction floors shall immediately update the new Form No. 01, income conditions, and sales consultancy documents for social housing projects applied from April 07, 2026.

  1. Notes and Recommendations

- Transitional Provisions: Documents proving income conditions that were certified by competent authorities prior to April 07, 2026 shall continue to be used and remain valid within 12 months from the date of certification.

(Pursuant to Article 2 Decree 136/2026/ND-CP)

- Provincial Authority to Adjust: Provincial-level People's Committees have the right to decide on the adjustment coefficient for these income levels based on local conditions, provided that it does not exceed the ratio of local per capita income to the national average.

(Pursuant to Point d Clause 1 Article 30 Decree 100/2024/ND-CP as amended in Clause 1 Article 1 Decree 136/2026/ND-CP)
